FDA Compliance Update: Pipe Tobacco and Product Sampling

To register or not to register (as a manufacturer)?

We have received many inquiries from our retailers about this issue.  This is an important question because if you are considered to be a “manufacturer” by FDA, then you are required to register and list your products with FDA.  It sounds like an easy question when you think about factories and other manufacturing facilities, but when FDA extended the definition to include certain activities that have long been performed by retailer it created uncertainty for all of us.  We have been asking FDA for clarification for some time about what, exactly a retailer can do and not be considered to be a manufacturer.  We are hoping to have more details soon, but here is what we currently have from FDA:

1)  By regulation at 21 C.F.R. § 1140.3: “Manufacturer means any person, including any repacker and/or relabeler, who manufactures, fabricates, assembles, processes, or labels a finished tobacco product.”
FDA’s definition of a “manufacturer” introduced some additional terms that need to be defined, namely “repacker,” “relabeler,” and “finished tobacco product.”

2)  The Tobacco Control Act does not define any of these terms, but it does talk about how “repackaging” can be considered to be “manufacturing.”  In particular, tobacco product “manufacturing, preparation, compounding, or processing” under the Tobacco Control Act includes “repackaging, or otherwise changing the container, wrapper or labeling of any tobacco product package from the original place of manufacture to the person who makes the final delivery or sale to the ultimate consumer or user.”

3)  Going back to the FDA regulation, note how it applies only to a “finished tobacco product.”  This term is not defined in the law or regulation, but in the deeming rule FDA said that a “finished tobacco product refers to a tobacco product, including all components and parts, sealed in final packaging intended for consumer use (e.g., filters, filter tubes, e-cigarettes, or e-liquids sold separately to consumers or as part of kits).

4)  Finally, FDA explained in the deeming rule that the way the Agency read the law, “retail establishments that blend pipe tobacco, are subject to and must comply with all applicable statutory and regulatory requirements for tobacco product manufacturers.”

So what does this mean?  Pipe tobacco has long been provided in bulk containers and retailers simply weigh out the amount the customer wants (with or without blending by the retailer).  One way to look at it is if the retailer does not “seal” the package of pipe tobacco provided to the consumer, then no “finished tobacco product” is created and therefore there is no requirement for the retailer to register as a manufacturer.  Another way to look at it is if the retailer provides the bulk tobacco but the customer weighs it out (with or without blending by the customer according to a “formula board” posted in the shop), then that is not manufacturing.  In addition, FDA has not said that a retailer is a manufacturer if the retailer simply weighs out a smaller quantity of bulk pipe tobacco for a customer.  Instead the Agency seems focused on a “blending” step, which would involve two or more bulk pipe tobaccos.  We have asked FDA about all of these issues (and many, many more!) but we don’t know how FDA will rule on these situations.  Finally, we are aware that at least some pipe tobacco manufacturers are packaging their products into smaller packages, which may affect whether a retailer needs to “repack” the product at all.

FDA believes that blending pipe tobacco is “manufacturing.”  Therefore, retailers that plan to continue blending pipe tobacco after December 31, 2016, must:

Register with FDA between August 8, 2016 and December 31, 2016. Registration forms and information about registering and listing electronically is available on FDA’s website. There is no registration fee.

Submit ingredient lists to FDA by August 8, 2017 if you are a small scale tobacco manufacturer that has 150 or fewer full-time equivalent employees and $5 Million or less of revenue. Otherwise submit ingredient lists by February 8, 2017.

Submit health documents on the effects from the pipe tobacco products to FDA by August 8, 2017 for small scale tobacco manufacturers. Otherwise submit health documents by February 8, 2017.

If you register and list a tobacco product, you then need to determine whether that product is grandfathered commercially marketed on February 15, 2007, (see FDA guidance here http://www.fda.gov/TobaccoProducts/Labeling/RulesRegulationsGuidance/ucm416495.htm), or whether you need to submit a substantial equivalence (SE) application (see FDA guidance here http://www.fda.gov/TobaccoProducts/Labeling/RulesRegulationsGuidance/ucm253273.htm), or whether you need to submit a premarket tobacco product application (PMTA) (see draft FDA guidance here  http://www.fda.gov/downloads/TobaccoProducts/Labeling/RulesRegulationsGuidance/UCM273425.pdf). The last day to submit an SE application to FDA is February 8, 2018, and the last day to submit a PMTA application to FDA is August 8, 2018.

Retailers that do not plan to register as a manufacturer with FDA should discontinue selling blended pipe tobacco by December 31, 2016. FDA has not explained whether any other practices would also constitute “manufacturing” but if they do, we will let you know as soon as possible.

Sampling

In our last update, we explained that effective August 8, 2016, retailers are not permitted to distribute free samples to consumers.  We also noted that IPCPR believes that the following practices do not violate the free sample provision, and have requested written confirmation from FDA:

Providing a cigar in exchange for buying other products (e.g. “buy one get one free”).
Replacing a plugged, spoiled, or otherwise damaged cigar for free.
Having a raffle with cigar(s) as prizes if there is a cost to enter the raffle.

We have not received a formal answer from FDA on these questions.  However, FDA has said:  “Given the public’s interest in the free sample prohibition provision, however, FDA intends to issue guidance in the future to further clarify the provision.”  We know this issue is of great importance to our retailers and we will update you as soon as we learn anything from FDA.

IPCPR’s Recommendation: A transaction must always take place, so keep a paper trail. IPCPR recommends exercising caution until we receive further explanation from FDA regarding the legality of specific practices and scenarios.

Hoyo La Amistad Debuts at IPCPR 2016

hoyo ajThe legendary Hoyo de Monterrey brand continues its bold march into the future with an intriguing, limited edition collaboration called La Amistad. The blend was developed by AJ Fernandez, the Cuban expat cigar maker best known for producing highly-rated cigars in Nicaragua.

Hoyo La Amistad is bold and full-bodied, and showcases the artisanal cigar making techniques and modern packaging of the new Hoyo launched earlier this year. Named for the camaraderie forged when creating this exciting new release, La Amistad means friendship in Spanish.

Alan Willner, vice president of marketing for General Cigar said, “AJ Fernandez embodies the same ethos as the Hoyo brand. His passion for the craft of cigar making is what led us to collaborate with him on La Amistad. This collection combines AJ’s love of tobacco and blending with the knowledge of Hoyo’s cigar makers in Honduras and Nicaragua.”

AJ Fernandez noted, “I grew up very near to the Hoyo de Monterrey farm and I have always had a love for the brand. When it came time to develop this blend, I put my heart and soul into it. To me, this project represents how far my family and I have come since Cuba, and how our expertise in tobacco continues to be recognized. This cigar represents the best of me and my factory and I am proud to be a part of this collaboration.”

La Amistad is brawny and robust, with notes of leather and spice. The wrapper is a bold Ecuadoran Habano, bound with a Nicaraguan leaf cultivated by AJ Fernandez in Esteli. The blend features powerhouse Nicaraguan tobacco from Esteli, Ometepe, Condega and Jalapa.

La Amistad is handcrafted at the AJ Fernandez cigar factory in Esteli, Nicaragua. It will be available in four sizes beginning in September. They are:

TOP PREMIUM CIGAR RETAILER DEBUTS INTERACTIVE CIGAR & BEER PAIRING GUIDE

EASTON, PA--(Marketwired - November 23, 2016) - Famous Smoke Shop, the leading online distributor of discounted premium cigars, has debuted their new interactive Cigar & Beer Pairing Guide. Created in partnership with The Man Guide, the pairing guide offers expert picks on 54 cigar and beer combinations, including detailed cigar ratings, in an easy-to-use interface for cigar smokers who want to make their cigar and beer experience more enjoyable.

"As we did with the Cigars & Spirits Pairing Guide earlier this year, we made the Cigar and Beer guide easy to use and very intuitive," said Cory Grover, Digital PR Specialist at Famous Smoke Shop. "Starting with the color of the beer -- light, medium, or dark -- the cigar smoker then selects the type of beer -- Amber Lager, IPA, or Bock -- and chooses one of six scenarios that will find the best cigar and beer for that situation."

The scenarios are also quite witty. For example, after the user chooses the type of beer they want, the page displays: "So you're drinking a [beer type]. What are you doing?" Then offers pithy circumstantial answers like, "Looking for Liquid Courage," "Planning on Taking a Sick Day Tomorrow," "Quitting Your Job in a Jerry Maguire-like Way," to mention a few.

Chosen by the experts at both Famous Smoke Shop and The Man Guide, the resulting pairings include selections from both major and boutique manufacturers for the cigars, and U.S. micro craft, large manufacturer, and international breweries for the beers.

Among the cigars users will find, along with numerous others, are the Perdomo Craft Series, Oliva Serie V, Montecristo White, Rocky Patel Edge, and Padrón F75, as well as beers from Anchor Brewery, Dogfish, Yuengling, Guinness, Victory, and dozens more. Detailed tasting notes for each pairing, plus consumer rating scores and other related articles about the breweries and cigars, are also included with the results.

"As a beer guy and a cigar smoker, doing the match-ups for the pairing guide was right in my wheelhouse," said The Man Guide's Beer Product Manager, Jorge Vazquez, who, with the Guide's Beer Editor, Javier Neciosup, co-wrote the pairing descriptions.

"I wish I had a resource like this when I was getting into cigars and beer," added Mr. Neciosup.

In addition to offering users the opportunity to find their ideal cigar and beer pairing, The Famous Smoke Shop Cigar Pairing Guide gives them the option to easily buy cigars online from Famous Smoke Shop.

As Famous Smoke Shop's Digital Marketing Director, John Lamberti said: "Famous has always been dedicated to selling cigars at the lowest prices, great customer service, and providing consumers with relevant information. That's why this pairing guide is such a great addition to our overall online content."

"For those who already appreciate and enjoy a good cigar with a tasty craft beer, the pairing guide will help them discover many new combinations," said Neciosup. "And as for those who are still developing their pairing skills, the guide will get them up-to-speed by offering the right pairing in a way that's both informative and fun."

HEDON DEBUTS ON INTERNATIONAL MARKETS

hedon1THE ONE AND ONLY FRENCH PREMIUM CIGAR BRAND

The region of Béarn, in south-west France, is best known for its picturesque villages and countryside, forests, rivers, lakes and, of course, for its excellent
food and wine.

Not many are aware that Béarn, which once belonged to the Navarre kingdom, is also the home of Hedon, the one and only premium cigar-maker,
working exclusively with 100% French tobacco grown here.

Hedon’s history dates back to 1999, when, for the first time, the idea of introducing cigar tobacco cultivation to this area and of setting up a small
luxury hand-made production became reality thanks to a group of French entrepreneurs. Since the start of the first tobacco plantation in Navarre,
exclusively dedicated to premium cigars, it has taken twelve years of research and experimentation to develop the optimal type of tobacco and master
a perfect production technique. The following years were employed to make the cigar production chain more efficient and more sustainable, introducing
advanced irrigation technologies in the fields and energy-saving systems in production facilities.

In 2015, backed by a small team of passionate shareholders and supported by the competence of expert artisans, a new management team brought
new energy to the project in order to develop the brand on international markets.

Today, Hedon intends to share its expertise and vision with the most demanding cigar lovers worldwide through a premium cigar range of
unique and unparalleled quality. Impeccably rolled by artisans of traditional expertise with fillers, binders and wrappers from the Pyrenean Piedmont,
Hedon cigars unveil subtle aromas and a deep body that slowly reveals itself, delivering an entirely new and unexpected experience.

Already named “Entreprise du Patrimoine Vivant” by the French government, Hedon stands in the wake of the most authentically French luxury
and offers an original tasting experience. Its sweet and aromatic notes, both typical and recognisable, are particularly sought after not only by cigar
aficionados but also by those who are approaching the cigar world for the first time.

hedon2THE MAKING OF A HEDON CIGAR

A cigar is never just a cigar, it is the pleasure of a moment that is just our own. It is a journey that started in the XVII century, when the first tobacco
plantations were introduced in France, and then reached this corner in the mild south-west.

Here, Hedon cigars are made, in the middle of a green and generous land, where tobacco cultivation takes place, giving life to a masterpiece of craftsmanship and savoir-faire.

www.hedon-cigares.com

Hedon is the first and unique French premium cigar where both the filler, the inside of the cigar, and the wrapper, its outer cover, are grown in the same area: it is the Navarre region at the foot of the Pyrenees. Unlike other places of production, however, in Navarre only a single variety of tobacco, especially
identified and developed to ideally suit this terroir, is grown and used for both components.

For this reason, Hedon tobacco leaves attain both a superior colour and appearance that are absolutely incomparable and stand out from all others, with
unique organoleptic characteristics.

In March, seeds are sown in the greenhouse. Two months later, the seedlings are transplanted into the ground, where they grow for about a month partly outdoors and partly under the shelter of light nets for a more balanced and harmonious ripening if they are destined for the most precious wrapper
leaves.

In Navarre, there is an abundance of pure natural mineral water, which springs from the Pyrenees: a pureness that is also to be found in Hedon cigars.
By accurately monitoring the real-time water requirements of plants, an advanced irrigation system guarantees that the water needs of the plants
are met in an optimal way.

When the plants reach optimum maturity, they are harvested and then left to dry in small automated dryers, fully self-sufficient in terms of energy
consumption and conceived to work, in detail, every single batch of the crops.

After two months, the dried tobacco is ready for fermentation, which takes place in such a way so as to allow a linear evolution of taste. In fact,
fermentation is needed to burn the sugars in the starch of leaves at the time of combustion. Perfect control of the fermentation process is therefore
essential to obtain a product that can release all its aromas and fragrances.

hedon3The leaves are then sorted and stacked to mature for at least three years. In due time, they are selected and processed by Hedon’s skilled artisans, who roll each cigar by hand with the utmost care, using only whole leaves. At the end of the manufacturing process, every cigar is draw tested to guarantee
maximum quality.

Three hundred separate operations are carried out to create a French “puro”. Every phase of the whole production process is important, from planting to
rolling, as the smallest detail affects the final taste: given the soil and climate, a daily effort is needed to guarantee an excellent product for consumers.

What really makes a difference in the cultivation of Hedon tobacco is a unique savoir-faire developed through a combination of technology and
intelligence, traditional knowledge and agricultural innovation, which over the years has resulted in high quality wrappers, binders and fillers that are
able to release all their complex aromas.

Famous Smoke Shop Launches Full Line-up of RoMa Craft Whiskey Rebellion 1794 Cigars

EASTON, PA--(Marketwired - July 21, 2016) - Famous Smoke Shop, a leading online distributor of discounted premium cigars, has announced a new line of cigars in conjunction with RoMa Craft Tobac. The cigar retailer specializes in offering the web's widest selection of cigars at the lowest prices -- and their newest selection is named Intemperance WR 1794. Already made immensely popular due to an early, limited edition release with CigarDojo.com, RoMa Craft has added multiple sizes within the brand, all of which will be made for sale only through Famous Smoke Shop. RoMa Craft's Intemperance line has been on the market since 2012 which includes the Intemperance EC XVII, and Intemperance BA XXI.

Whiskey Rebellion 1794 cigars by RoMa Craft Tobac take their name from the protest known as the Whiskey Rebellion, which began in 1791 under George Washington's presidency. Washington's Treasury Secretary, Alexander Hamilton, introduced a tax on all distilled spirits in an attempt to lower the nation's debt without raising the nation's already-high import taxes; the Whiskey Tax was the first tax on domestic goods in United States history, and was roundly -- and vehemently -- opposed by many rural American communities.

RoMa Craft Cigars owner Skip Martin embraced this outrage and insurrection as the inspiration for the newly expanded cigar line. "Our forefathers believed the Whiskey Tax to be illegal, under the idea that there was no local representation," said Martin, "and they stood their ground. What this cigar represents to me, then, is that when faced with tyrannous taxes and regulations -- we must resist." It's his nod to how Hamilton's tax resulted in conflict between citizens and law enforcement, when 500 armed men in Western Pennsylvania rose up in dissent; Washington called militias from the surrounding States to quell the rebellion, though no violence erupted. Skip noted, "but the message that these Whiskey Rebellion patriots sent, was received." The Whiskey Tax was eventually repealed by Thomas Jefferson, after federal agents struggled to enforce it.

Whiskey Rebellion 1794 cigars feature a complex blend of Nicaraguan and Dominican longfiller tobaccos, an Indonesian Besuki binder, and Ecuadorian Habano wrapper, and comes in multiple sizes -- each named after an instrumental political figure who had a hand in the creation and abolition of the Whiskey Tax. After sampling the new Whiskey Rebellion cigar, Famous Smoke Shop Copywriter & Cigar Advisor Jonathan Detore said, "All of us here are extremely excited about taking on this incredible line of cigars. The smoke is bold and flavorful, with a profile that will appeal to many cigar smokers. With so much history behind this cigar, especially in the state of Pennsylvania where our company is based, we are especially proud to make this a long-term addition to our wide selection of premium cigars."

Intemperance WR 1794 Cigars will debut Monday, July 25 at the International Premium Cigar & Pipe Retailers' 84th Annual Convention and Trade Show; available exclusively at Famous Smoke Shop, it will arrive for sale in five sizes: a 4 x 46 Hamilton, 4 ½ x 52 Jefferson, 5 x 50 McFarlane, 5 x 56 Bradford, and 5 ½ x 54 Washington. The majority of the line offers 24 cigars per box, while the 4 x 46 Hamilton vitola offers 30 cigars in each package. With Famous' full discount pricing, customers will enjoy this new offering with individual retail prices ranging from $6.15 to $8.00 per cigar. The first shipment will arrive at Famous Smoke Shop's warehouse in August; and while the company has expressed that the new brand will be a consistent offering for the foreseeable future, Whiskey Rebellion cigars will be available in limited quantities.

Fratello Oro is the company’s first time working with an Ecuador Connecticut wrapper. “We wanted a mild to medium cigar with a creamy after taste but that it also embodies the true nature of our company which is full flavor cigars.” Said de Frias.

Fratello Oro was blended with a Connecticut Ecuador wrapper, Cameroon Binder with Nicaraguan and Dominican Filler. Fratello Oro will be making its official debut at this year’s IPCPR show in Las Vegas.

Protocol Probable Cause Released

Cubariqueño Cigar Co. is proud to announce that it is releasing its second blend, Protocol Probable Cause, at the 2016 International Premium Cigar and Pipe Retailer (IPCPR) trade show in Las Vegas.

“We are super excited to announce the Protocol Probable Cause,” stated Juan Cancel, co-founder of Cubariqueño Cigar Company. “These cigars will launch at the 2016 IPCPR trade show.”

The name, Probable Cause, stays true to the company’s law enforcement motif, with co-founders Bill Ives and Cancel both law enforcement officers. Production will remain at Erik Espinosa’s La Zona factory in Estelí, Nicaragua.

Probable Cause will be available in two offerings, a round 5 x 52 Robusto with a closed foot and a 6 ½ X 48 Churchill semi-box-pressed, also with a closed foot.

Probable Cause is elegantly wrapped in a stunning Mexican San Andreas Maduro leaf with a smooth, oily appearance. Its all- [probable cause cigar] Nicaraguan filler is enveloped by a Nicaraguan binder.

“We are classifying Probable Cause as a medium-strength cigar with full flavor,” explained Cancel.

The robusto will retail for $9.69 and the Churchill will have a M.S.R.P. of $9.89. Both vitolas will be available in boxes of 10.
Also being introduced at this year’s trade show will be a line extension to the original Protocol release. The highly anticipated Protocol Lancero will make its official debut this summer in Las Vegas.

The Protocol Lancero will stand in at 7 ½ x 38. The blends of all Lancero offerings must be tweaked slightly to maintain intended flavor notes and proper draw. The Protocol Lancero will undergo those modifications while continuing to use the Ecuadorian Habano Oscuro wrapper, Nicaraguan binder andall-Nicaraguan filler. It will be available in 10-count boxes.  The price of the lancero has yet to be determined.

“The Protocol Lancero is being introduced as a small-batch production depending on its success with possible increased production in the future,” said Ives.

Cubariqueño Cigar Co. will be celebrating its one-year anniversary with a special event at Berkeley Humidor on May 21.

“The Protocol Lancero and Probable Cause will be made available for purchase for our loyal customers at this event prior to the 2016 IPCPR trade show,” stated Bill Agathis, co-owner of Cubariqueño Cigar Co. and owner of Berkeley Wine and Humidor.

FAMOUS SMOKE SHOP & DREW ESTATE DEBUT OLDE PENN CIGARS AT LEAF

FAMOUS SMOKE SHOP & DREW ESTATE DEBUT OLDE PENN CIGARS AT LEAF

Easton Eatery & Cigar Lounge Presents a Night of Cigars, Brews, Local Dishes & Blues

EASTON, PA--(Marketwired - July 11, 2016) - On Saturday, July 16th from 4:00 - 9:00 PM, Famous Smoke Shop, the leading online distributor of discounted premium cigars, specializing in offering the web's biggest selection of cigars at the lowest prices, will be rolling out the red carpet at Leaf Restaurant & Cigar Lounge in Easton, PA to welcome Olde Penn cigars, a new premium cigar selection blended at La Gran Fabrica Drew Estate in Nicaragua. The festivities will include in-store deals on Olde Penn cigars, beer samplings, Pennsylvania-inspired food dishes & cocktails, plus live music provided by Easton-based, blues-rock guitarist, John Cannavo, and his band, Free Agent Status.

Olde Penn - Old School Attitude

Life in Olde Penn was anything but pedestrian. Its people worked hard, played fair and stood up for what they believed in. When they met adversity face-to-face, they gave it a wry look and spit in its eye. Pennsylvanians business was building America. They followed their fathers into the coal mines, forged America's railways in their steel mills, tamed the Great Lakes, and 4,600 cigar factories (more than any other state in the Union), plus myriad Keystone State tobacco farms, satisfied the nation's appetite for a good smoke.

Suffice it to say, Pennsylvania's roots run deep, hold fast, and remain strong. And it's in this unanimous, spirited and determined tradition that Olde Penn cigars were forged with the same grit and determination that's been coursing through Pennsylvanians veins since 1682.

Olde Penn cigars are handcrafted with choice Nicaraguan longfillers skillfully rolled in a plush Connecticut-seed wrapper grown in Ecuador. The smoke is smooth, creamy, and mild-to-medium in body, while supplying rich layers of earth and spice.

The cigars are presented in handsome-looking boxes of 20 cigars in the following five shapes: (Prices shown are MSRP per cigar.)

Olde Penn Small Corona (4½" x 43) $6.00

Olde Penn Robusto (5" x 50) $6.75

Olde Penn Lonsdale (7" x 46) $6.50

Olde Penn Toro (6"x 52) $7.25

Olde Penn Gordito (6" x 60) $7.50

During the event, anyone who buys a box of Olde Penn cigars will receive a special Drew Estate Event Sampler and a rare, Liga Privada UNICO "Velvet Rat" cigar. Those who buy any other box of Drew Estate Liga Privada cigars will receive the Event Sampler plus a rare, Liga Privada "A" cigar.

VUDU "BLOOD" CIGARS NOW AVAILABLE AT FAMOUS SMOKE SHOP
New Line Extension Blended by Jesus Fuego is 4th in VUDU Cigars Series

EASTON, PA--(Marketwired - August 16, 2016) - Famous Smoke Shop, the leading online distributor of discounted premium cigars, specializing in offering the web's widest selection of cigars at the lowest prices, has announced the arrival of VUDU Blood cigars, the fourth installment in the VUDU cigars' lineup, and it comes with a very attractive price point. As the name suggests, VUDU Blood carries forward the themes inspired by the mystical Haitian religious practices, which are also reflected in the striking red and white humidor jar packaging adorned with line art drawings of snakes, skulls, and other cadaverous creatures.

Created by master blender, Jesus Fuego, VUDU Blood starts with a full-bodied blend of perfectly-aged Honduran Criollo, Dominican Piloto Cubano, and Pennsylvania sun-grown filler tobaccos cinched in a Costa Rican binder leaf, and finished in a dark, oily Nicaraguan Corojo Maduro wrapper.

Fuego, a Cuban expatriate whose family heritage in the tobacco growing trade dates back more than 130 years, is known for producing some of the most flavorful Corojo-leaf cigars in the business; a success that began with the release of his Gran Reserva Corojo No.1 cigars introduced in 2007.

The following VUDU Blood sizes are presented in collectable, refillable vacuum sealed humidor jars of 19 cigars:

No.3 (4¾" x 50 Robusto) $4.25/cigar MSRP

No.7 (5¾" x 50 Toro) $4.70/cigar MSRP

No.9 (6¾" x 50 Churchill) $5.15/cigar MSRP

A fourth size, No.13, is a 5½" x 46 Corona presented in a bundle of 13 cigars with an MSRP of $3.80 per cigar.

"I think they've hit pay dirt with this one," said CigarAdvisor.com editor, Gary Korb, during a recent tasting session of the new cigars. "The smoke is smooth, full, and well-balanced with a rich, earthy-cedary baseline augmented by flavors of leather, cocoa, roasted coffee and sweet spices on a peppery finish," he added.

Korb also compared VUDU Blood to Jesus Fuego's highly-rated Sangre De Toro cigars, which are only sold at retail cigar stores.

CAO Launches CONSIGLIERE Line

CAO Consigliere left openThere was a great CAO cigar that came in a red lacquered box. One day it was gone. Everyone assumed it was sleeping with the fishes.

A certain crew of guys who smoke CAO made us an offer we couldn’t refuse. They said bring back that wise guy cigar, or else. So we delivered the goods.

CAO Consigliere is a straight sequel -- the five-country blend is the same as before, the one that made it to Cigar Aficionado’s Top 25 list in 2006.

Consigliere is handmade in Nicaragua, with a Brazilian Mata Fina wrapper, bound with a Honduran leaf and features a blend of Nicaraguan, Dominican and Colombian leaves. This is a bold cigar with flavors of espresso, wood and spice.

Consigliere will be pulled back in as a full-time member of the CAO family starting in October, with suggested retail prices that are less than the original. Three new sizes were created for the launch. They are:

Associate -- 5 x 52; SRP per cigar is $6.99

Soldier -- 6 x 54; SRP per cigar is $7.99

Boss -- 7 x 56 Torpedo; SRP per cigar is $8.99

Rick Rodriguez, CAO’s blender/ambassador was mostly tight-lipped about the new Consigliere launch. “Right now, all I can say is leave the cannolis and take the cigars. Capisce?”

Rick will hit the road later this year, doing events across the U.S. to celebrate the return of this tough guy smoke.

Introduction: The Series
Ernesto Perez-Carrillo always set out to lead the industry in innovative and groundbreaking ideas. Each Series is based on a greater concept that defines the cigars that make up that specific series. Ernesto Perez-Carrillo and the entire E. P. Carrillo Cigar Co. family introduce to you The Series.

Family Series: Generations Honored
Perez-Carrillo, as a name, has been known in the Cigar Industry for years. Ernesto is a Junior and his father before him and the family before that all have been integrally involved in making cigars for generations. Only these cigars are allowed to bear the name Perez-Carrillo and each vitola is an homage to someone within the family. Cigars that are the pride and joy of the Perez-Carrillo family history.

He adds to his claim to fame by having created the INCH line and since it is all about dimensions, his next claim to fame is the smaller ring gauge, Interlude and the non traditional sized Rebel. IPCPR Alert: Cigar Imports

On August 8, 2016, FDA’s deeming regulations went into effect, extending FDA’s authority over tobacco products to cover cigars, e-cigarettes, and all other tobacco products.  Although additional requirements relating to cigar manufacture, packaging, labeling, and promotion will be implemented in the future, one of the more immediate impacts of FDA jurisdiction over the cigar industry will be at the import level.

Cigar imports are now subject to FDA review.  As a result, brokers will need to provide additional information about the cigar product and wait for FDA to review this information and ultimately release these entries.  Essentially, product release goes from a one-step process (release by Customs only) to a two-step process (release by Customs and by FDA).

To briefly summarize the process, a customs broker will need to identify the country of origin of the import, provide a written description of the product (usually obtained from the invoice), the name and address of the manufacturer, the name and address of the shipper (obtained from entry documents), and generate a “product code.”  Entry information is typically submitted electronically and your import broker should be familiar with the procedure, however FDA review is an additional step that will add time to the import process, and importers should be prepared for this.  If your customs broker needs additional information on the importation procedure for an FDA-regulated product, it can be found here:

http://www.fda.gov/forindustry/importprogram/entryprocess/entrysubmissionprocess/default.htm

Like other FDA-regulated products, FDA reviews and subsequent entry releases can be as quick as a few hours after receipt of information, or can take days/weeks if information transmitted is incorrect, incomplete or FDA has questions about product compliance.  Cigar importers should be aware of the potential for an import delay.

IPCPR, CAA & CRA File Lawsuit Against FDA Today

WASHINGTON, D.C. -  The three major cigar and tobacco industry associations filed suit Friday against the United States Food and Drug Administration's "Deeming Rule." The Cigar Association of America, International Premium Cigar and Pipe Retailers Association, and the Cigar Rights of America are asking the District Court for the District of Columbia for a declaratory injunction "vacate, set aside and enjoin the enforcement of the final rule" because it is violates numerous federal statutes as well as the federal rulemaking process. A full copy of the filing, which details nine counts against the FDA and the United States Department of Health and Human Services, can be found here.
"Just over one month ago, our three associations pledged to work together to develop the appropriate response to the FDA's new deeming rule. After a thorough and detailed legal review, we are challenging this unlawful regulatory action in federal court to protect the statutory and constitutional rights of our industry and its members. The fact that all three of our organizations are acting in once voice speaks to the urgency and seriousness of this action," said Mark Pursell, CEO of the International Premium Cigar and Pipe Retailers Association.
The complaint challenges:
  • FDA's improper application of the February 15, 2007 grandfather date to cigars and pipe tobacco, which subjects those products to more intrusive regulations than cigarettes and smokeless tobacco
  • FDA's impermissible assessment of a tax in the form of user fees, and its allocation of these user fees only to cigars and pipe tobacco and not to other newly deemed products
  • FDA's failure to perform an adequate cost-benefit analysis to take into account the effects of the Final Rule on small businesses as is required by the Regulatory Flexibility Act
  • FDA's unjustified decision to require cigar health warning labels to be 30% of the two principal display panels of packages
  • FDA's unlawful designation of tobacconists who blend finished pipe tobacco or create cigar samplers of finished cigars as "manufacturers," which subjects those businesses to greater regulation than if they were "retailers"
  • FDA's incorrect decision to regulate pipes as "components" or "parts" rather than as "accessories"
"The FDA ignored the law to craft these expansive and sweeping regulations and cannot justify many of the arbitrary and capricious regulations it purports to enact," said Glynn Loope, Executive Director of Cigar Rights of America. "This lawsuit is a specific and detailed challenge to the FDA's unprecedented assertion of rulemaking authority. "We are acting in one voice to protect the legal rights of our industry at all levels, from the manufacturer, the community retail tobacconist, to the adult patrons of cigars."
Speaking about the lawsuit, Cigar Association of America President Craig Williamson said, "We all worked in good faith to inform and educate the FDA on the unique nature of our industry, its members and our consumers. We hoped the FDA would craft a flexible regulatory structure that accounted for the uniqueness of our industry. Instead, we got a broad, one-size-fits-all rule that fails to account for how cigars and premium cigars are manufactured, distributed, sold and consumed in the United States. The FDA exceeded its statutory authority and violated the federal rulemaking process when crafting this set of broad and sweeping regulations. This challenge asserts nine violations of federal law and rulemaking authority. We are asking the court to enjoin the enforcement of this unlawful regulatory scheme. We are confident that when the court reviews our case on its merits, we will prevail."

New Cohiba--Macassar!

macassarDistant from even the most primitive modes of transportation, Indonesian Macassar is arguably the most difficult ebony in the world to procure and one of the world’s most beautiful exotic woods. In a fitting tribute to this extraordinary work of nature, the artisans of Cohiba have created Cohiba Macassar, a new collection that lends itself to extravagant smoking occasions as readily as it does to life’s most treasured moments.

Only the finest leaves were selected to meet the exacting standards of taste and aesthetics set forth for Macassar. As such, this super-premium expression is made solely of proprietary tobaccos, each aged for more than four years including a year of finishing in Dominican rum barrels.
The blend of Cohiba Macassar is centered on a supple Connecticut Havano wrapper grown in a micro climate that helps to achieve a richer, more flavorful tobacco, yet with far less yield than  traditional plants. To deliver a refined wrapper with barely perceptible veins, only the finest seco leaves are chosen for Cohiba Macassar.

The blend is made with a proprietary Dominican seed cultivated by Cohiba’s agronomists in Mao, complemented by a Nicaraguan Jalapa leaf grown exclusively for Cohiba. The Connecticut Broadleaf binder is aged six years to impart a mellow flavor and optimal combustibility.

Cohiba Macassar brings forth nuanced notes of wood and spice. The flavor is distinctive and unmistakable, bearing subtle references to other blends in the Cohiba portfolio.

Handcrafted in the Dominican Republic, Cohiba Macassar will make its debut fine cigar shops nationwide beginning in August. This remarkable collection will be a full-time addition to the Cohiba portfolio and will be launched with three sizes, each protected in 10-count boxes.
