LEGISLATIVE ALERT!! NEW THREATS TO CIGARS

Rep. Pallone Introduces New Comprehensive Tobacco Bill

Yesterday, Congressman Frank Pallone (D-NJ), chairman of the Energy & Commerce Committee, along with Congresswoman Donna Shalala (D-FL), introduced a comprehensive tobacco bill. The bill, “To amend the Federal Food, Drug, and Cosmetic Act with respect to the sale and marketing of tobacco products, and for other purposes” (H.R. 2339), will be called the ‘‘Reversing the Youth Tobacco Epidemic Act of 2019.While premium cigars have not contributed to this epidemic, they would still be significantly impacted by this legislation. The bill would amend the 2009 Family Smoking Prevention and Tobacco Control Act, originally designed to curb youth access to cigarettes. This new legislation would extend the current regulations on cigarettes to all other deemed products, including cigars. It also introduces a number of new restrictions on tobacco sales.

How “Reversing the Youth Tobacco Epidemic Act of 2019” would impact premium cigars:
 
Ban Online Sale of All Deemed Tobacco Products – Online sales of cigarettes and smokeless tobacco products were banned in 2010, but this bill would extend that rule to ALL deemed products, which currently includes premium cigars.
 
Increase User Fees – The FDA would have explicit authority to collect fees from all deemed products in addition to cigarettes and the total amount of fees collected by the agency would increase by $100 million.
 
Raise Minimum Tobacco Purchase Age to 21 – The minimum age to purchase tobacco would be 21 nationwide. There is no provision prohibiting states or localities from raising the minimum age above 21.

Advertising & Sales Restrictions – All cigarette advertising and sales restrictions would also apply to premium cigars. This means advertising any tobacco brand on non-tobacco merchandise (such as t-shirts or other apparel) is prohibited; event sponsorship (music, sports, etc.) by a tobacco brand or manufacturer is prohibited; and free gifts (even non-tobacco) in exchange for consideration of purchasing a tobacco product is prohibited.
 
Ban Flavored Tobacco Products – Characterizing flavors of all tobacco products would be prohibited under this Act.

IPCPR opposes this legislation. We will continue to engage with lawmakers to work to seek fair treatment of premium cigars by the FDA. Premium cigars are a 100% natural, artisan product and should not be regulated the same as cigarettes or electronic nicotine delivery systems. We are continuing to gain support and co-sponsors for our exemption bills in both the Senate (S.9) and the House (H.R. 1854). J.C. Newman Cigar Company will release its first Tobacconist Association of America (TAA) exclusive brand, Brick House Ciento por Ciento.

Handcrafted in J.C. Newman's Nicaraguan factory, Puros de Estelí Nicaragua, S.A. (J.C. Newman PENSA), Ciento por Ciento only uses tobaccos grown in the rich, volcanic soils of Nicaragua. It is the first Nicaraguan puro blend in the Brick House line, hence the name, which means 100% in Spanish. The wrapper is a Habana-seed, corojo leaf grown in the Jalapa Valley which encloses binder and filler from three of Nicaragua's mountainous regions.

Rubio to Convene Hearing

Washington, D.C. — U.S. Senator Marco Rubio (R-FL), Chairman of the Senate Committee on Small Business and Entrepreneurship, will convene a hearing titled, "Keeping Small, Premium Cigar Businesses Rolling" on Friday, April 5, 2019, at 1:00 PM. Directly following the hearing, Rubio will hold a brief media availability.
 
The hearing will look at the climate of overregulation of the premium cigar industry, an iconic staple to Florida's economy. Earlier this year, Rubio re-introduced the Traditional Cigar Manufacturing and Small Business Jobs Preservation Act of 2019, which seeks to exempt premium cigars from excessive and overly burdensome U.S. Food and Drug Administration (FDA) regulations and fees. Last year, Rubio spoke on the Senate floor on behalf of his amendment to save the premium cigar industry after leading a bipartisan letter to the FDA that urged an exemption of premium, hand-rolled cigars from these overreaching regulations, which threaten American premium cigar manufacturers and retailers, and could force this industry of mostly small businesses across the country to close. In 2016, Rubio visited Tampa's J.C. Newman Cigar Company to meet with workers whose paychecks are being threatened by destructive regulations from Washington. In 2014, Senator Rubio penned an op-ed that called for "a halt to unnecessary federal regulations that threaten" this industry.

David Lafferty new VP Sales at Dunbarton

Lafferty then served as the Executive Director of Nat Sherman International in their premium cigar division until his scheduled departure on February 28th, 2019. He will assume the responsibilities of his new position with Dunbarton Tobacco & Trust on March 1st, 2019.

Congressman Posey Prioritizes Premium Cigar Exemption at Appropriations Member Day

ipcprlogoOn Tuesday, March 26, 2019, the House Appropriations Subcommittee on Agriculture held a hearing on member priorities. Congressman Posey (FL-08), a long time premium cigar champion, took this critical opportunity as a chance to shed light on the harmful impact FDA regulations have had on the premium cigar industry.

Congressman Posey stated: “To provide a common-sense solution, Rep. Kathy Castor and I reintroduced H.R. 1854 which would define premium cigars and exempt a narrow artisan category from the burdensome FDA regulations which they cannot meet.” The bill already has 30 bipartisan supporters in Congress and had 149 last Congress, exemplifying why the subcommittee should consider including this language in the FY 20 bill.
The FY 19 Agriculture Appropriations Bill included premium cigar exemption language and passed in the House but was not adopted into the final version of the budget bill.

Congresswoman Castor Introduces HR 1854 to Exempt Premium Cigars

ipcprlogoWASHINGTON, D.C. – Congresswoman Kathy Castor (D-FL) introduced the Traditional Cigar Manufacturing and Small Business Jobs Preservation Act of 2019 (“HR 1854”), which calls for a premium cigar exemption from regulation by the U.S. Food & Drug Administration (“FDA”).

The bill would protect main street mom and pop small businesses and traditional handcrafted premium cigar manufacturers from regulations currently affecting their businesses.

“IPCPR is very pleased that there is a strong bi-partisan support for the thousands of premium cigar retailers throughout this country and the many thousands our members employ,” said Scott Pearce, IPCPR executive director.  “We are proud that as we have engaged policy makers, our message that continuing with existing and planned regulations on this artisanal industry will cripple it to the point of obsolescence, has resonated and is gaining momentum.”

IPCPR President Ken P. MIAMI – Montecristo, maker of world renowned premium cigars, will host an exclusive Montecristo Art Basel event in South Florida’s most popular pop-up event space: The Wharf Miami. The event “Montecristo Marina” hosted by the Montecristo Social Club will combine live art, fine spirits, music, networking and Montecristo cigars while overlooking the Miami River.
